Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Tongo mobile application and the website at real-time-translator.net (collectively, the "Service"), operated by System Art Design LLC ("we," "our," or "us").
By downloading, installing, or using Tongo, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Tongo. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. The Service
Tongo provides real-time voice translation between two speakers using Apple's on-device Translation framework. The App supports English, Spanish, Russian, Italian, German, Polish, and French. Translation accuracy may vary and should not be relied upon for medical, legal, safety-critical, or emergency communications.
We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We will not be liable to you for any modification, suspension, or discontinuation.
3. Accounts and Registration
Tongo does not require you to create an account. No username or password is needed to use core translation features. Subscription purchases are managed through your Apple ID via the App Store.
4. Subscriptions and Payments
4.1 Free Tier
Tongo offers a free tier with 5 minutes of translation per day and access to 3 languages at no charge.
4.2 Paid Subscriptions
Premium access is available through auto-renewing subscriptions:
- Weekly — $4.99 per week, unlimited translation, all 7 languages
- Annual — $29.99 per year, unlimited translation, all 7 languages, priority support
Prices are in USD and may vary by region as displayed in the App Store. All payments are processed by Apple Inc. under Apple's terms. We do not store your payment information.
4.3 Renewal and Cancellation
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. To cancel, visit your iPhone Settings → Apple ID → Subscriptions → Tongo.
4.4 Refunds
All refund requests are handled by Apple in accordance with their refund policy. We do not issue refunds directly. To request a refund, visit reportaproblem.apple.com.
5. Acceptable Use
You agree not to use Tongo to:
- Violate any applicable law or regulation
- Harass, threaten, or harm any person
- Translate or distribute content that is illegal, defamatory, obscene, or infringes third-party rights
- Reverse engineer, decompile, or otherwise attempt to extract the source code of the App
- Circumvent any technical restrictions or access controls
- Use the Service in any way that could damage, disable, or impair it
6. Intellectual Property
The Tongo App, logo, wordmark, and all associated content are owned by System Art Design LLC and protected by United States and international intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes, subject to these Terms. This licence does not include the right to sublicense, sell, resell, or commercially exploit the Service.
7. Translation Accuracy Disclaimer
Tongo's translations are generated by Apple's on-device Translation framework and are provided for informational and conversational purposes only. Translations may be inaccurate, incomplete, or contextually incorrect. Do not rely on Tongo for medical diagnoses, legal advice, emergency services, or any context where an inaccurate translation could result in harm. Always verify critical information with a qualified human translator.
8. Limitation of Liability
To the maximum extent permitted by applicable law, System Art Design LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of data, loss of revenue, or harm resulting from reliance on translations.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $10, whichever is greater.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
10. Indemnification
You agree to indemnify and hold harmless System Art Design LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or relating to your use of the Service or violation of these Terms.
11. Governing Law and Disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to its conflict of law principles.
Any dispute arising from these Terms or the Service shall first be attempted to be resolved informally by contacting us at support@real-time-translator.net. If not resolved within 60 days, disputes shall be resolved by binding individual arbitration in accordance with the American Arbitration Association rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
12. Third-Party Services
The Service relies on Apple's Translation framework, App Store, and StoreKit. Your use of these Apple services is subject to Apple's Terms of Use. We are not responsible for the availability, accuracy, or practices of any third-party service.
13. Changes to These Terms
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing in-app notice. Your continued use of Tongo after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, stop using the Service.
14. Miscellaneous
- Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and System Art Design LLC regarding the Service.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Assignment. You may not assign your rights under these Terms without our written consent. We may assign our rights at any time.
